TENANCY AGREEMENTS/ASSIGNMENTS/REGISTRATION/NOTICES

Preparation and execution of appropriate documentation to facilitate/record new/additional / replacement occupants entering a tenancy – Includes  Tenant screening (References) and RTB update as required – It is a common occurrence in the rental sector, where a property is rented to a group of individuals sharing and tenants/occupants rotate without tenants informing or obtaining consent from their landlord and often unaware of their direct responsibilities to the incoming Licencee/Sub-tenant.  ie. That they (Tenant) are in fact the Landlord of the Licencee/Sub-tenant and not the property owner.

Often a tenancy can evolve to a situation where none of the original tenants remain in occupation and an entirely different group of individuals are in possession of the property but with no formal tenancy agreement or rights and this can lead to significant complications, difficulties, and stress for both landlord and residual occupants. It is always advisable and beneficial to have a formal Agreement drawn up and executed as appropriate by a landlord and their tenants. In turn, tenants should always have a formal agreement in place with co-habitants that are not joint and several tenants of the tenancy agreement with the property owner.
