Statutory Notices & Rent Reviews Service
Tenancy Termination Notice
Written statutory formal Notice of valid Tenancy Termination (served on tenants) in prescribed form plus all required associated documentation in accordance with the Residential Tenancies Act and Includes RTB update & Notice Of Termination Return Form protocols.
Rent Arrears
A specific protocol must be adhered to when pursuing rent arrears from a tenant which includes initial warning letters in prescribed form before ultimately serving a Termination notice if issue remains unresolved.
Misc Notices
Any formal letter of warning or notice required to be served on tenants regarding any breach of the terms of their tenancy, including but not limited to issues such as Anti-Social behaviour ; Neglect of the property resulting in damages ; illegal or inappropriate use of the property for illicit purposes ; overcrowding or pets being kept in the property without consent. Etc.
Rent Reviews
Under the terms of the Residential Tenancies Act 2004 and subsequent Amendment(s) rent may not be increased without the Tenant being provided with 90 days formal written Notice of any impending increase and which should be accompanied by comparable evidence of similar rents of at least three similar properties in a comparable location…Current legislation introduced on 16th July 2021 dictates that Rent Reviews for properties within Rent Pressure Zones, (RPZs are areas where rents are highest and rising quickly) are now capped and linked to general inflation also known as the Harmonised Indices of Consumer Prices (HICP).
RPZs were initially introduced on 24th December 2016 and rent increases in RPZs were previously capped at 4% per year but in response to rising inflation this system was subsequently changed again on 9th December 2021 annual rent increases were capped at a maximum of 2%. RPZs were also extended until 31st December 2024…These changes came in under the Residential Tenancies (No. 2) Act 2021. The RTB website has information on general inflation, and how it relates to RPZs. Such Notice of rent review may only be served after 12 months of a tenancy has elapsed since the rent was initially fixed / first set. Following first review, rent may be reviewed annually but properties located outside an RPZ area must wait 24 months before serving notice of initial rent review.
Where Christies PMP carry out a Rent Review, the service will include rent calculations via the RTB Rent calculator, comparison searches, negotiating with tenants directly, preparation and issuing of appropriate formal written Notice in the prescribed form to tenants, preparation and issuing and overseeing execution of relevant tenancy documentation and updating the RTB accordingly as required.
